LEGAL
Terms of Service
1. About these terms
These terms are an agreement between you and [OPERATOR: COMPANY OR INDIVIDUAL NAME], [POSTAL ADDRESS] ("we", "us"). They cover the Voycut Windows app, your Voycut account, the AI service the app uses, and this website (together, "Voycut"). By creating an account or using Voycut, you accept these terms. Our Privacy Policy explains how we handle personal data.
2. The free beta
- Voycut is currently a free beta. We don't charge for it and don't ask for payment details.
- Your access lasts for the beta period. We may end the beta, or change what's included, at any time. If we introduce paid plans, we'll tell you in advance, and you won't be charged unless you choose to sign up for one.
- The AI service runs on a shared plan with a total usage cap. When it's reached, AI features may be unavailable for a while. We may add usage limits during the beta.
- Beta software can contain bugs and may change without notice. Keep your own copies of your footage and projects.
3. Your account
You must be at least [MINIMUM AGE, e.g. 16] years old to use Voycut. Give a real email address you control, keep your password private, and don't share your account. You're responsible for what happens under your account. Tell us at [CONTACT EMAIL] if you think someone else has used it.
4. What Voycut does and doesn't do
Voycut analyzes your clips, plans a video and chooses shots, then writes a preview and a project for another editing program. It doesn't export a finished video file. AI output can be wrong or unsuitable, so review everything before you publish it.
Voycut writes projects compatible with CapCut and DaVinci Resolve. Those programs are made by other companies under their own terms. We aren't affiliated with or endorsed by them, and their updates may stop Voycut's projects from opening.
5. Your content
Your footage, text and the projects Voycut makes from them ("your content") remain yours. You give us permission to process your content only as needed to provide Voycut, including sending the parts described in the Privacy Policy to our AI service providers.
You're responsible for your content. You confirm that you have the rights needed to use the footage, music, images, voices and likenesses of people in it, and that using it with Voycut, and publishing the result, doesn't break the law or anyone else's rights.
6. Acceptable use
Don't use Voycut to:
- process or create content that is illegal, infringes someone's rights, sexually exploits minors, or harasses, defames or deceives people;
- get around usage limits, access the AI service outside the Voycut app, or resell access to it;
- interfere with, overload, probe or attack Voycut or its providers;
- break the usage policies of our AI service providers, as they apply to you through us [LINK OR SUMMARY OF UPSTREAM USAGE POLICY].
We may suspend or close an account that breaks these rules or puts the service at risk.
7. The software
We give you a personal, non-exclusive, non-transferable, revocable license to install and use the Voycut app on your Windows computers during the beta. Don't sell, rent or redistribute it, and don't remove notices from it. Voycut includes open-source components, such as FFmpeg, that are licensed under their own terms. Those terms apply to those components and are listed in the app's third-party notices.
The app doesn't update itself. We may require you to install a newer version before you can keep using AI features.
8. Availability
We provide the beta "as is" and "as available". We don't promise any level of uptime, and we may pause, limit or turn off the AI service at any time, for example to fix problems or control costs. The parts of Voycut that don't need the AI service keep working on your PC.
9. Feedback
If you send us ideas or feedback, we may use them to improve Voycut without owing you anything.
10. Disclaimer
To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that Voycut will be error-free, that its output will meet your needs, or that projects will open in any particular version of another program.
11. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill. Our total liability for all claims relating to Voycut is limited to the greater of the amount you paid us in the 12 months before the claim and [AMOUNT, e.g. USD 50].
Nothing in these terms limits liability that can't be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you're a consumer, you keep the rights that the law of your country gives you and that can't be waived by contract.
12. Ending your use
You can stop using Voycut at any time and ask us to delete your account as described in the Privacy Policy. We may end or suspend your access if you break these terms, or when the beta ends. Sections 5, 9, 10, 11 and 14 continue to apply after that.
13. Changes to these terms
We may update these terms. For significant changes we'll tell you by email or in the app before they take effect. If you keep using Voycut after that, the new terms apply. If you don't agree, stop using Voycut.
14. Governing law
These terms are governed by the laws of [GOVERNING LAW JURISDICTION], and disputes go to the courts of [VENUE]. If you're a consumer living elsewhere, this doesn't take away the protection of the mandatory laws of your country or your right to bring a claim in your local courts.
